GAYA PERUMUSAN KALIMAT PERINTAH PEMBENTUKAN PERATURAN YANG MENJALANKAN DELEGASI DARI UNDANG-UNDANG DI INDONESIA

Peraturan delegasi dari Undang-Undang menjadi sebuah kebutuhan yang penting agar Undang-Undang yang dibentuk dapat berjalan dengan baik. Untuk memastikan peraturan delegasi itu dapat mendukung pelaksanaan Undang-Undang lebih baik, dimulai dari perumusan kalimat perintah delegasi kepada peraturan yang dibawahnya. Peraturan perundang-undangan yang mengatur mengenai sistim pembentukan peraturan perundang-undangan di Indonesia telah memberikan pedoman bagaimana perumusan hal tersebut. Dari 3 (tiga) peraturan perundang-undangan mengenai teknik penyusunan peraturan perundang-undangan jelas mengatur bagaimana perumusan perintah pendelegasian. Cukup jelas ketiganya memberikan pedoman, sayangnya penelitian pada pada proses pembentukan peraturan delegasi dari Undang-Undang sejak tahun 1999 sampai dengan 2012 menunjukkan tidak semua perumusan yang ada mengikuti pedoman pedoman tersebut.

Abstract

The delegation regulation from the Act becomes an important requirement so that the Law that is formed can run well. To ensure that the delegation's regulations can support the implementation of the Act better, starting from the formulation of the delegate's command sentence to the regulations below. The statutory regulations governing the system of establishing laws and regulations in Indonesia have provided guidance on how these are formulated. Of the 3 (three) statutory regulations regarding the techniques of drafting legislation clearly regulating how the formulation of delegation orders. Quite clearly all three provide guidelines, unfortunately research on the process of forming delegation regulations from the Act from 1999 to 2012 shows not all the formulations that follow the guidelines.
