PENERAPAN CYBER NOTARY DALAM PEMBUATAN AKTA NOTARIIL TANPA BERHADAPAN SECARA FISIK DI SAAT PANDEMI COVID 19 (STUDI KASUS PEMBUATAN AKTA OLEH NOTARIS R PADA TAHUN 2021)

Abstrak

Kewajiban notaris dalam pembuatan akta autentik diatur di dalam Undang-Undang Jabatan Notaris, salah satunya adalah kewajiban membacakan akta di hadapan penghadap dengan dihadiri oleh paling sedikit dua orang saksi atau empat orang saksi khusus dan ditandatangani pada saat itu juga oleh penghadap, saksi dan Notaris yang bersangkutan. Dalam praktiknya, kewajiban tersebut dilakukan dengan mengadakan pertemuan fisik secara langsung dengan penghadap yang datang menghadap kepada notaris atau ketika notaris mendatangi dan berhadapan dengan klien guna kepentingan pembuatan akta. Namun, dengan Pemberlakuan Pembatasan Kegiatan Masyarakat (PPKM) akibat adanya pandemi Corona Virus Disease (Covid 19), pertemuan fisik secara langsung tersebut dibatasi guna mencegah penyebaran Covid 19. Pembatasan tersebut tentu bertentangan dengan kewajiban pembacaan dan penandatanganan akta sebagaimana diatur Pasal 16 ayat (1) huruf (m) Undang-Undang Jabatan Notaris tersebut. Keadaan ini memberikan hak bagi notaris untuk menjalankan kewenangan lain selain yang diatur oleh Undang-Undang Jabatan Notaris dalam rangka pembuatan akta di tengah masa pandemi Covid 19, salah satunya adalah dengan melakukan sertifikasi transaksi yang dilakukan secara elektronik (cyber notary) sebagaimana diatur dalam Pasal 15 ayat (3) Undang-Undang Jabatan Notaris. Maka dari itu, tulisan ini menganalisis mengenai praktik pelaksanaan cyber notary dalam rangkaian pembuatan akta notariil yang dibuat tanpa berhadapan secara fisik saat Pandemi Covid 19.

Abstract

The obligation of a notary in the making of an authentic deed is regulated in the Law number 2 of 2014 regarding The Notary Position (UUJNâ€), one of which is the obligation to read the deed before the appearers in the presence of at least two witnesses or four special witnesses and signed at the same time by the appearers, witnesses and the notary. In practice, this obligation is carried out by holding a direct physical contact with the appearers who come before the notary or when the notary comes and deals with the client for the purpose of making the deed. However, with the Implementation of Restrictions on Community Activities (PPKM) due to the Corona Virus Disease (Covid 19) pandemic, direct physical contacts are limited to prevent the spread of Covid 19. These restrictions are certainly in contrary to the obligation to read and sign the deed as stipulated in Article 16 paragraph (1) letter (m) of the UUJN. This situation gives the notary the right to exercise other authorities in addition to those regulated by the UUJN in the context of making a deed in the midst of the Covid 19 pandemic, one of which is by certifying transactions which carried out electronically (using cyber notary) as regulated in Article 15 paragraph (3) of UUJN. Therefor this article analyzes the practice of implementing cyber notary in the making of notarial deed which is made without direct physical contact during the Covid 19 Pandemic.
