TANGGUNG JAWAB ATAS BENDA SITAAN DALAM PERKARA PIDANA YANG DILAKUKAN OLEH KEPOLISIAN

Abstract


ABSTRAK

Benda sitaan adalah barang bukti yang disita oleh aparat penegak hukum yang berwenang untuk kepentingan pembuktian di sidang pengadilan. Hukum positif Indonesia mengatur mengenai penyidikan atas benda sitaan yaitu diatur di dalam KUHAP. Rumah Penyimpanan Benda Sitaan Negara atau disingkat Rupbasan adalah tempat benda yang disita oleh negara untuk keperluan proses peradilan. Fungsi tempat penyimpanan benda sitaan yaitu tempat benda yang disita oleh negara untuk keperluan proses peradilan. Di dalam Rupbasan ditempatkan benda yang harus disimpan untuk keperluan barang bukti dalam pemeriksaan dalam tingkat penyidikan, penuntutan dan pemeriksaan di sidang pengadilan termasuk barang yang dinyatakan dirampas berdasarkan putusan hakim. Kepolisian mempunyai tugas pokok yaitu memelihara keamanan dan ketertiban masyarakat, menegakkan hukum, serta memberikan perlindungan, pengayoman dan pelayanan kepada masyarakat. Diharapkan agar Penyidik yang mengetahui, menerima laporan atau pengaduan tentang terjadinya suatu peristiwa yang patut diduga merupakan tindak pidana wajib segera melakukan tindakan penyidikan yang diperlukan, lebih efisien lagi dengan memperhatikan hukum positif Indonesia di dalam hal pengaturan mengenai penyidikan atas benda sitaan yang diatur di dalam KUHAP, Dalam hal Penyidik telah mulai melakukan penyidikan suatu peristiwa yang merupakan tindak pidana, Penyidik memberitahukan hal itu kepada Penuntut Umum. Diharapkan agar fungsi tempat penyimpanan benda sitaan sebagai tempat benda yang disita oleh negara untuk keperluan proses peradilan lebih berfungsi secara maksimal dalam hal penyimpanan benda-benda yang harus disimpan untuk keperluan barang bukti dalam pemeriksaan dalam tingkat penyidikan, penuntutan dan pemeriksaan di sidang pengadilan termasuk barang yang dinyatakan dirampas berdasarkan putusan Hakim.

ABSTRACT

Confiscated objects are evidence confiscated by law enforcement authorities who are authorized for evidentiary purposes in a court hearing. Indonesia's positive law regulates the investigation of confiscated objects, which is regulated in the Criminal Procedure Code. State Confiscated Object Storage House or abbreviated as Rupbasan is a place where objects are confiscated by the state for the purpose of the judicial process. The function of the place of confiscated objects is the place of objects seized by the state for the purposes of the judicial process. In Rupbasan, objects that must be stored for evidence in examination at the level of investigation, prosecution and examination at a court hearing are included items that have been confiscated based on the judge's decision. The police have the main duties of maintaining security and public order, enforcing the law, and providing protection, protection and services to the community. It is expected that Investigators who are aware of, receive reports or complaints about the occurrence of an event that is reasonably suspected of being a criminal offense must immediately conduct the necessary investigative actions, more efficiently by observing Indonesia's positive law in terms of the provisions regarding investigations of confiscated objects stipulated in the Criminal Procedure Code In the event that an Investigator has commenced an investigation into an event which constitutes a criminal offense, the Investigator shall inform the Prosecutor of such matter. It is expected that the function of confiscated objects as confiscated objects by the state for the purpose of the judicial process will function more optimally in terms of storage of objects that must be stored for the purposes of evidence in the examination at the level of investigation, prosecution and examination at court including goods that are declared seized based on the judge's decision.
