PERSPEKTIF PENEGAKAN HAK ASASI MANUSIA MELALUI PENGADILAN HAK ASASI MANUSIA

Hak asasi Manusia (HAM) menjadi hal mendasar untuk dipastikan pemenuhan perlindungannya karena tanpa HAM maka kemuliaan manusia terdistorsi. Selain itu, negara melakukan pelanggaran atas kontrak dibentuknya negara itu sendiri yang dipastikan untuk melindungi HAM. Belum lagi, HAM sendiri akan tercermin di konstitusi, yang bila HAM dilanggar, praktis konstitusi telah dilanggar dengan sendirinya. UU tentang Pengadilan HAM mengatur mulai dari penyelidikan, penyidikan, penuntutan dan persidangan dalam kasus pelanggaran HAM berat. Namun sayangnya sebagian besar aturannya masih menginduk pada KUHAP. Hasil kajian menunjukkan terdapat berbagai kelemahan di dalam UU Pengadilan HAM seperti dari ketidakjelasan unsur rumusan di dalam pengertian kejahatan kemanusiaan, tidak ada mekanisme menyelesaikan perbedaan pendapat antara penyelidik dan penyidik serta tidak diatur mengenai pembentukan pengadilan HAM ad hoc secara komperhensif.

Abstract
Human Rights (HAM) is fundamental to ensure the fulfillment of its protection because without human rights, human glory is distorted. In addition, the state violates the contract for the formation of the state itself which is ensured to protect human rights. Not to mention, human rights themselves will be reflected in the constitution, which if human rights are violated, the constitution has practically been violated by itself. The Law on Human Rights Courts regulates from investigation, investigation, prosecution and trial in cases of gross human rights violations. But unfortunately most of the rules are still subject to the Criminal Procedure Code. The results of the study show that there are various weaknesses in the Human Rights Court Law, such as the unclear elements of the formulation in the definition of crimes against humanity, there is no mechanism to resolve differences of opinion between investigators and investigators and are not regulated regarding the formation of an ad hoc human rights court in a comprehensive manner.
